law and the magic circle

The magic circle is also used to claim that the metaverse, or all of cyberspace, is somehow beyond the reach of law. Weirdly enough you find groups like Linden Lab trying to argue that the magic circle is selective, and that it shields them when they want shielding but only when they (not others) want shielding. In an even more extreme view, for example, you occasionally meet people who insist the law cannot touch the metaverse in any way. That seems to be the somewhat unsuccessful legal strategy that led to the default judgement for the plaintiff in Eros LLC v John Doe. See, for instance, Theory of property and Law in Virtual Worlds.
